Welcome to "Royal Matrimony" (www.royalmerry.com), the India's largest and finest Match making site. This document is an electronic record in terms of the Information Technology Act, 2000 and rules therein pertaining to such act and amendment. This electronic record is generated by a computer system and does not require any physical or digital signatures. This Agreement sets out the legally binding terms for your use of the Site and membership. This Agreement may be modified by "Royal Matrimony" from time to time and Service provider reserves such rights.
"Royal Matrimony"(hereinafter referred to as "the Site") and the licensed mobile application for accessing the Site (including all associated media and online or electronic documentation, referred to as ''the Application'', are hereinafter collectively referred to as “Platform”.
This document is published following the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 which require publishing the privacy policy, rules and regulations, and the terms and conditions for access or usage of www.royalmerry.com (the "Website").
The "Royal Matrimony" makes available its services to you, through the Platform on the condition that you abide by these Terms and Conditions, as updated from time to time by the service provider.
The Site is for the personal use of individually registered members to advertise, promote and share their profiles to find relevant matches or life partners and cannot be used in connection with any commercial endeavors or for casual dating/contacting.
Please read the following terms and conditions carefully before using this website. accessing, browsing, or otherwise. using the website implies your agreement to be bound by all these terms and conditions ("Agreement"). If you do not comply with the provisions herein, you are advised not to use or access the Platform and/or avail of the "Royal Matrimony" services provided by this platform.
1. Eligibility:
i. To register as a member of "Royal Matrimony" or use this Site, you must be of legal marriageable age as per the laws of India or to which you are subject. The "Royal Matrimony" is only to facilitate lawful marriages between persons who are legally competent to enter into matrimony under the laws to which they are subject. Membership in the Service is void where prohibited.
ii. If you have applied for Divorce, you may register on our website/App by stating "Awaiting Divorce" or if the divorce decree has been passed, you have to submit the required documents for the sake of verification by another preferred user, if they wish to.
iii. By using this site, you acknowledge that you have the right, authority and legal capacity to use it and to enter into this agreement and that you are not prohibited/prevented by any applicable laws for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony.
iv. You also agree to abide by all of the terms and conditions of this Agreement. If at any time, "Royal Matrimony" may consider you ineligible to become a member if you have made any misrepresentation about your eligibility, "Royal Matrimony" reserves the right to forthwith terminate your membership or block your account and /or your right to use the Service without any refund for services not availed.
v. You acknowledge that by using this site, you intend to seek a life partner and you shall not use this site for casual dating or contacting.
2. Terms of Use:
i. To use the "Royal Matrimony" Service you must register as a member on the Website/ mobile applications ("Site") and by using the Site, you agree to be bound by these Terms of Use ("Agreement").
ii. If you want to promote or advertise or share your profile with other registered users and make use of the "Royal Matrimony" service ("Service"), read these Terms of Use and follow the instructions in the registration process. By using the Service, you consent to submit your personally identifiable information including sensitive personal data including financial data (if opted for our paid membership), Identity proofs if submitted, religion, caste, etc, to collect, process, display, and use the said information to provide the Service and if you have any objection in collecting/processing your data, we advise you not to register with our Site.
iii. If found in breach of these terms "Royal Matrimony" may terminate your membership or remove your profile or block access to the Site with or without informing you.
iv. If you want to withdraw this consent or if you have any objection to the continuous collection or storage of your details, you may discontinue by deleting your account or by sending an email from your registered email ID to "Royal Matrimony".
3. Non-Commercial Use by Members.
The "Royal Matrimony" Site is for the personal use of individual members only, and cannot be used in connection with any commercial endeavors or for casual dating, or such contact. This includes providing links to other websites, whether deemed competitive to "Royal Matrimony" or otherwise. Organizations, companies, and/or businesses cannot become members of "Royal Matrimony" and should not use the Services/Site for any purpose. Illegal and/or unauthorized uses of the Services, including unauthorized framing of or linking to the Site will be investigated and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
4. Other Terms of Use by members.
i. "Royal Matrimony" reserves the right in its sole discretion to review the activity & status of each account & block/ discontinue/ remove the account/ profile of a member based on such review.
ii. Multiple profiles of the same person are not allowed on "Royal Matrimony". "Royal Matrimony" reserves the right to deactivate all multiple profiles.
iii. You hereby confirm that as of the date of this registration, you do not have any objection to receiving emails, SMS/WhatsApp messages/ calls from or members of "Royal Matrimony" and as long as you are a registered member of "Royal Matrimony" including SMS permission for authenticating mobile verification transactions via OTP, sent by the Payment Gateway. The consent to this extends to emails, messages or calls relating but not limited to phone number verification, the provision of matchmaking advertising service, matchmaking inquiries, advertisements, and promotions. The consent to this shall supersede any preferences set by you with or registration is done with the Do Not Disturb (DND Register)/ National Customer Preference Register (NCPR).
iv. You acknowledge and confirm that the information including the personal information as provided by you (as referred as "Consent") is correct and accurate.
v. You are strongly advised to submit a copy of your Aadhar Card, Driving License, Passport, or any other Government issued identity and add a trust badge to your profile.
vi. You cannot engage in advertising to or solicitation of, other Members to buy or sell any products or services through the Service.
vii. You will not transmit any chain letters or junk emails, or inappropriate messages to other "Royal Matrimony" members.
viii. Though "Royal Matrimony" does not monitor the conduct of its Members off the "Royal Matrimony" Site, it is also a violation of these rules to use any information obtained from the Service to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. To protect "Royal Matrimony" and/or our Members from any abuse/misuse, "Royal Matrimony" reserves the right to restrict the number of communications/profile contacts & responses/emails that a Member may send to other Member.
ix. You acknowledge not using any automated processes, including IRC Bots, EXEs, CGI, or any other programs or scripts to view content on or communicate or contact or respond or interact with "Royal Matrimony" and/or its members.
x. "Royal Matrimony" reserves the right to monitor messages/ chats or such communications that you may send to other Member(s) and also regulate the same by deleting and/or editing unwarranted/ obscene communications at any time at its sole discretion without prior notice to any Member.
xi. "Royal Matrimony" reserves the right to take appropriate steps to protect "Royal Matrimony" and/or its Members from any abuse/misuse as it deems appropriate in its sole discretion.
xii. You hereby agree that you shall not use the Services and the platforms to harass any member.
5. Account Security.
You are responsible for safeguarding the confidentiality of your SMM logins credentials such as your user Id, password, OTP, and other details to prevent unauthorized access to your account. We do not ask for Passwords and you are cautioned not to share your password with any persons. You agree to accept and take responsibility for all activities that occur under your account.
6. Proprietary Rights of Content on "Royal Matrimony".
"Royal Matrimony" owns and retains all proprietary rights in the "Royal Matrimony" Site and the "Royal Matrimony" Service. The Site contains the copyrighted material, trademarks, and other proprietary information of "Royal Matrimony", and its licensors. Except for that information which you have been given permission, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempt on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by "Royal Matrimony".
7. Content Posted on the Site.
i. You understand and agree that "Royal Matrimony" may delete any detail, messages, photos or profiles (collectively, "Content") that in the sole judgment of "Royal Matrimony" violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either "Royal Matrimony" and/or its Members.
ii. With respect to content you submit or make available for inclusion on publicly accessible areas of the Site including but not limited to your contact details, you hereby unconditionally and irrevocably grant to "Royal Matrimony" the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Site or on other medium from time to time.
iii. You understand and hereby agree that all information, data, text, graphics, messages photographs, tags, or other Content whether publicly posted or privately transmitted or otherwise made available to "Royal Matrimony’s members, are the sole responsibility of the person from whom such Content originated and shall be at the member's/person's sole risks and consequences.
iv. "Royal Matrimony" does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
v. Under no circumstances will "Royal Matrimony" be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
vi. You are solely responsible for the Content that you publish or display or post on the "Royal Matrimony" Site or transmit to other Members of it.
vii. We may from time to time review the content posted on Site and "Royal Matrimony" reserves the right to remove the content or block/ discontinue/ remove the account/ profile of a member based on such review, on sole discretion of "Royal Matrimony", if there is any doubt on its authenticity.
viii. In exercising its rights, "Royal Matrimony" may ask you to provide any document or other form of evidence supporting the Content you post on the Site/app. By posting Content to any public area of "Royal Matrimony", you automatically grant, and you represent and warrant that you have the right to grant, to "Royal Matrimony", and other members of "Royal Matrimony", an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
ix. The following is an indicative list of the kind of Content that is illegal or prohibited on the Site. "Royal Matrimony" will investigate and take appropriate legal action in its sole discretion against anyone who violates this Agreement, including without limitation, removing the offending communication / Content from the Service and terminating the Membership of such violators. Illegal and prohibitive Content includes Content which:
Ø is offensive to the community, such as Content that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual;
Ø harasses or advocates harassment of another person;
Ø involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
Ø promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
Ø contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;
Ø displays pornographic or sexually explicit material of any kind;
Ø provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
Ø provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
Ø solicits passwords, personal identifying information or such information for commercial or unlawful purposes from other users; and
Ø Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
Ø You must use the "Royal Matrimony" Service in a manner consistent with any and all applicable local, state, and federal laws, rules and regulations.
8. Copyright Policy:
You cannot post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
9. Member Disputes:
You are solely responsible for your interactions/messages/chats and such related activities with other "Royal Matrimony" Members. "Royal Matrimony" reserves the right, but has no obligation, to monitor disputes between you and other Members. "Royal Matrimony" also reserves the right to take appropriate action against errant members. However, "Royal Matrimony" is not obliged to share such action with other members, including complainants. "Royal Matrimony" expressly does not hold responsibility or liability against or for any Member at "Royal Matrimony".
10. Privacy
At "Royal Matrimony", the privacy of our users is of extreme importance to us. This section outlines the types of personal information is received and collected by "Royal Matrimony" and how it is used.
i. "Royal Matrimony" is an online matrimonial service designed to provide an easy way for our members to meet each other on the Web. To accomplish this, our members create their own unique profiles and our matching technology provides them matches based on their pre-selected criteria. In order to do this, we ask for certain personal and sensitive information which is displayed on the site. (This information includes physical/mental-disability.)
"Royal Matrimony" also allow members to submit public and private information on behalf of others - child/ward, sibling or friend but with their prior consent and "Royal Matrimony", if required may ask for the evidence of the same.
ii. We use your server, IP address, and browser-type related information for the general administration of our website. We may store member login ids of users and their IP addresses for certain activities they perform with the purpose to track down the illegal activities and persons concerned.
iii. Like many other sites, "Royal Matrimony" uses Google Analytics and log files to collect information that is not personally identifiable, such as browser type and IP address.
iv. Cookies and Web Beacons - "Royal Matrimony" uses cookies to store information about user's preferences, record user-specific information on which pages the user access or visit, customize Web page content based on the user's browser type or other information that the visitor sends via their browser. If you wish to disable cookies, you may do so through your browser options but the site may not function normally with it.
11. Disputes:
In case of any dispute about or involving the Site and/or the Service, by the use of the site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts located in New Delhi.
12. Indemnity:
You agree to indemnify and hold "Royal Matrimony", its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part.
